These terms govern your access to and use of this website and any order you place with Sourced. By browsing the site or placing an order you agree to these terms in full. If you do not agree, please do not use the site.

1. Who we are

Sourced operates this website. References to we, us and our mean Sourced. References to you and your mean the person browsing the site or placing an order.

2. Eligibility

You confirm that you are at least 18 years old, or that you have the consent of a parent or guardian, and that you have the legal capacity to enter into a binding contract in your country of residence. You confirm that all information you give us is accurate and complete.

3. Products and descriptions

We take care to describe products accurately. Product images are for illustration. Colour reproduction varies between screens and devices, and packaging, labelling and minor design details can change between production runs without notice. Slight variation between the image shown and the item delivered is normal and is not a defect.

All products are offered subject to availability. We may change or withdraw any product at any time.

4. Orders and acceptance

Your order is an offer to buy. No contract exists between us until we send you a dispatch confirmation. An order confirmation email is an acknowledgement that we received your order. It is not acceptance of it.

We may refuse, limit or cancel any order at our discretion, including where the product is unavailable, where we identify a pricing or description error, where we suspect fraud or unauthorised use of a payment method, where we suspect the order is placed for resale, or where we cannot complete required verification checks. If we cancel a paid order we will refund the amount charged in full and that refund is your sole remedy.

5. Pricing and errors

Prices are shown in the currency selected at checkout and can change at any time before your order is accepted. Despite our best efforts a small number of items may be mispriced or misdescribed. Where the correct price is higher than the price shown we will contact you before dispatch and you may confirm at the corrected price or cancel. We are not obliged to supply at an incorrect price.

6. Payment

Payment is taken through our payment providers. We do not store your full card details. You confirm that you are authorised to use the payment method you provide. If a payment is reversed, charged back or fails after dispatch we may recover the sum owed and any reasonable costs of recovery.

7. Delivery

Delivery windows shown on the site are estimates given in good faith and are not guaranteed. Time is not of the essence. We are not liable for delays caused by carriers, customs authorities, weather, industrial action or other matters outside our reasonable control.

Risk in the goods passes to you on delivery to the address you supply. If you give an incorrect or incomplete address, or nobody is available to accept delivery, any additional cost is yours.

8. Customs, duties and import taxes

International orders may attract import duties, taxes and customs charges levied by the destination country. Where these are not collected at checkout they are your responsibility and are payable by you. We have no control over these charges and cannot predict them. Refusal to pay them, or refusal of a parcel at customs, is treated as a cancellation by you and any resulting cost is not refundable.

9. Returns

All sales are final. We do not accept returns or exchanges for change of mind, incorrect size selection or incorrect product selection.

If an item arrives faulty, damaged in transit or materially different from its description, contact us within 7 days of delivery with your order number and clear photographs. Where we confirm a genuine fault we will provide a replacement or a refund at our option.

Nothing in this section affects any statutory right you hold under the law of your country of residence. Consumers in the United Kingdom and the European Union may hold a statutory right to cancel certain distance contracts within a set period, and those rights apply regardless of the paragraph above.

10. Authenticity

We source through authorised channels. Where we supply branded goods, all trade marks, logos and brand names remain the property of their respective owners. Use of a brand name on this site is for identification of the product only and does not imply that the brand endorses or is affiliated with Sourced.

11. Intellectual property

The design, layout, text, graphics and original photography on this site are owned by or licensed to us and are protected by intellectual property law. You may view and print pages for your own personal use. You may not copy, reproduce, republish, sell or exploit any part of the site for commercial purposes without our written permission.

12. Acceptable use

You agree not to use the site unlawfully, not to attempt to gain unauthorised access to any part of it, not to introduce malicious code, not to scrape or harvest data from it by automated means, and not to place orders using false details or another person's payment method.

13. Accounts

If you create an account you are responsible for keeping your credentials secure and for all activity under your account. Tell us immediately if you suspect unauthorised use. We may suspend or close an account where we reasonably suspect misuse.

14. Third party links

The site may link to third party websites. We do not control them, we do not endorse them and we accept no responsibility for their content, their products or their privacy practices. Visiting them is at your own risk.

15. Availability of the site

We do not warrant that the site will be available uninterrupted or free from error. We may suspend, withdraw or restrict all or part of the site for business or operational reasons without notice.

16. Disclaimer

The site and its content are provided on an as is and as available basis. To the fullest extent permitted by law we exclude all representations, warranties and conditions that are not expressly set out in these terms, whether implied by statute, common law or otherwise.

17. Limitation of liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of the terms implied by section 12 of the Sale of Goods Act 1979, for defective products under the Consumer Protection Act 1987, or for any other liability that cannot lawfully be limited or excluded.

Subject to that paragraph, we are not liable for any loss of profit, loss of business, loss of opportunity, loss of anticipated saving, loss of data or any indirect or consequential loss however arising. Subject to that paragraph, our total liability to you in connection with any order is limited to the amount you paid for that order.

These limits apply to the fullest extent permitted by law. If you are a consumer, your statutory rights are unaffected.

18. Indemnity

You agree to indemnify us against any claim, loss, damage or reasonable cost we suffer arising from your breach of these terms, your misuse of the site or your infringement of the rights of any third party.

19. Events outside our control

We are not liable for any failure or delay in performing our obligations where that failure or delay results from an event outside our reasonable control, including but not limited to acts of God, war, civil unrest, epidemic, fire, flood, failure of public or private telecommunications networks, carrier failure, import restrictions or acts of government.

Our Privacy Policy explains how we collect and use personal information and forms part of these terms.

21. Changes to these terms

We may revise these terms at any time. The version in force is the one published on this page when you place your order. Continued use of the site after changes are published means you accept the revised terms.

22. Entire agreement and severability

These terms, together with our policies referenced in them, form the entire agreement between us regarding your use of the site. If any provision is found to be unlawful or unenforceable, that provision is severed and the remaining provisions continue in full force.

23. Waiver

A failure or delay by us in enforcing any provision of these terms is not a waiver of our right to enforce it later.

24. Third party rights

A person who is not a party to these terms has no right to enforce any of them under the Contracts (Rights of Third Parties) Act 1999.

25. Governing law and jurisdiction

These terms and any dispute arising out of them are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere in the United Kingdom or in the European Union you may also bring proceedings in the courts of your country of residence, and you retain the benefit of any mandatory consumer protection provisions of that country.
